This course will assist the adjuster in learning how to identify the elements necessary for a legal and binding contract as well as hold harmless agreements and Indemnity Agreements. The adjuster will learn about the components of a tort action, how those issues come together through investigation of facts to decide who was at fault, and how the adjuster should proceed on the claim. The adjuster will frequently have to work with civil law to understand the financial responsibilities in the claims process. After completing this course, the adjuster will be able to analyze evidence, understand what a bailment is, identify an agency relationship, identify a non-commercial joint venture, recognize an independent contractor and their relationship to the principal, understand and apply land laws, apply statutes of limitations, which vary by state.
